England was the last part of the United Kingdom to implement the radical legislation on 1 July this year. The aim is to create a healthier environment so that everyone can socialise, relax, travel, shop and work free from secondhand smoke.

The case
Hamish Howitt of the Happy Scots Pub in Blackpool did not ensure that he accurately implemented the legislation and flouted the ban by allowing patrons to smoke on the premises. However, Mr Howitt does not regret this decision, even though he now faces a criminal record and a fine of up to £17500. Mr Howitt has defiantly declared that he would rather go to prison than pay the fine. Is this a stance that you would be prepared to take?
