Companies must update websites and email footers

As of the 1st of January 2007, companies in the UK must include certain regulatory information on their websites and email footers or face a fine for breaching the Companies Act. This update to the previous 1985 legislation has been enacted by the Companies (Registrar, Languages and Trading Disclosures) Regulations 2006 and was brought in due to a change in European law, the First Company Amendment Directive.

Every company now has to list its registration number, place of registration and registered office on its order forms, emails and websites. Such a duty previously existed for letters, but the duty has now been extended to cover all aspects of e-commerce. It is strongly advisable to provide this information within the signatures to company emails.

The Ecommerce Regulations 2002 require that the company registration number and place of registration are displayed on all websites, including those that do not sell online. This information does not have to be on every page but can instead be provided in an ‘about us’ section or legal information page.

Information to include on the website
  • The name, geographic address and email address of the service provider. The name of the organisation with which the customer is contracting must be given
  • It is not sufficient to include a 'contact us' form without also providing an email address and geographic address
  • If a company, the company's registration number should be given and, under the Companies Act, the place of registration should be stated
  • If the business is a member of a trade or professional association, membership details, including any registration number, should be provided
  • If the business has a VAT number, it should be stated
  • Prices on the website must be clear and unambiguous, stating clearly whether prices are inclusive of VAT or delivery charges
